Fruit Hut Terms of Use

Fruit Hut is a single-player game that runs entirely on your device. There are no accounts, no servers, and no ads, and the only thing you can buy is an optional tip that grants nothing. Most of what usually fills a terms page does not apply here. What follows is the short set that does.

1. Who we are and acceptance

Fruit Hut (the "App") is made by Kinetic Flux, LLC ("Kinetic Flux," "we," "us"). By installing or playing the App you agree to these Terms of Use and to our Privacy Policy. If you do not agree, do not use the App.

2. Your licence to use the App

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and play the App on devices you own or control, for your own entertainment. You may not sell, rent, sublicense, or redistribute the App, and you may not reverse engineer, decompile, or modify it except to the extent that law expressly allows despite this restriction.

3. Your saved game

Your progress is stored in a file on your device and nowhere else. We have no copy of it and cannot restore it. Deleting the App, resetting the device, or using the in-game "Start over" option erases it permanently. Backing up your device is the only way to preserve a save.

4. Tips, ads, and virtual currency

The App shows no advertising. It contains one optional in-app purchase: a tip jar on the About screen. A tip is a voluntary payment to us and buys nothing. It grants no currency, no unlocks, no content, and removes no restriction, because there is none to remove. The complete game is available to you whether or not you ever tip.

Tips are sold and processed by Apple or Google under their own terms, and any refund is theirs to give, not ours. The tip amounts are consumable, which means each one can be given more than once and is not restored to a new install. Nothing in the App is gated on having tipped, so a reinstall costs you nothing but the thank-you note.

Cash, fruit, and any other in-game item exist only inside the simulation, have no monetary value, and cannot be exchanged for money or anything of real-world value.

5. Intellectual property

The App, including its software, art, text, and the Fruit Hut and Kinetic Flux names and marks, is owned by Kinetic Flux, LLC or its licensors and protected by law. All rights not expressly granted are reserved. The App includes third-party open-source components under their own licences; those notices are reproduced in full inside the App under About → Licenses, and each component's licence governs that component.

6. App stores

If you obtained the App through the Apple App Store or Google Play, your download and any refund are also governed by that store's terms, and refunds are handled by Apple or Google under their policies. Apple and Google are not parties to these Terms and have no obligation to provide support for the App.

7. Updates and availability

We may update, rebalance, or discontinue the App at any time. An update may change how the game plays. We are not obliged to keep any particular version, feature, or balance available.

8. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT SAVED DATA WILL NOT BE LOST.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KINETIC FLUX, LLC AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA OR SAVED PROGRESS, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR THE APP OR USD $50. Nothing in these Terms excludes liability that cannot be excluded by law, and some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above; continued use after changes take effect constitutes acceptance.

11. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-laws rules.
